COMMON QUESTIONS

Questions we often hear

Do I need a will if I have CPF nominations?
CPF monies do not form part of your estate and are distributed according to your CPF nomination, not your will. However, assets outside of CPF — such as bank accounts, property, and investments — are governed by your will. Having both in place, and ensuring they are consistent with each other, is generally advisable.
How long does the will drafting process take?
Most wills are drafted and executed within one to two weeks of the initial consultation. The timeline depends on the complexity of your estate and the instructions provided. We will confirm a timeline after our first meeting.
What is the difference between a revocable and an irrevocable trust?
A revocable trust can be amended or dissolved by the settlor during their lifetime. An irrevocable trust, once established, generally cannot be changed without the consent of the beneficiaries. Each structure has different implications for asset protection, taxation, and estate administration. We advise on the appropriate structure based on your objectives.
At what age should I consider putting an LPA in place?
An LPA can only be made while a person has mental capacity. Many Singaporeans put one in place from their forties onward, though there is no minimum age beyond 21. The earlier it is registered, the more it reflects a considered, deliberate choice. It is one of those documents where waiting carries real risk.
Can I update my will after it has been signed?
Yes. A will can be revoked or amended at any time while you have testamentary capacity. Changes may be made by way of a codicil (a formal amendment) or by executing an entirely new will. We recommend reviewing your will after significant life events such as marriage, the birth of a child, or acquisition of substantial assets.
Are your consultations confidential?
All consultations are conducted under legal professional privilege. Your instructions and personal circumstances are treated with strict confidentiality in accordance with our professional obligations. We do not share client information with third parties except where required by law.
