How estate planning helped these families
A blended family situation requiring careful planning
A client in his late forties had children from two relationships and wished to ensure that all children were provided for equitably, while also making provision for his current partner who was not legally married to him.
A will making specific provision for the partner during her lifetime, with the residuary estate distributable among all children in agreed proportions. The CPF nomination was also reviewed and coordinated with the will.
The client left with a clear plan that addressed his concerns for all parties and with an understanding of how the documents would operate after his death. The matter was completed within two weeks of the initial consultation.
Siblings preventing a costly deputyship application
A family contacted us after a parent had been diagnosed with early-stage dementia. A doctor had confirmed the parent still had mental capacity, and the family wanted to put an LPA in place before that window closed.
Both personal welfare and property and affairs LPAs were prepared promptly, with two of the adult children appointed as donees. A certificate issuer was arranged within the week, and OPG registration was submitted without delay.
The LPAs were registered before the parent's capacity was assessed as insufficient to grant a new one. The family avoided a Court of Protection deputyship application, which would have taken considerably longer and at greater expense.
A discretionary trust for a family with a vulnerable beneficiary
A couple had three adult children, one of whom had a disability that meant they could not manage assets independently. They wanted to provide equally for all three children, but with appropriate safeguards for the one who needed them.
A testamentary trust was incorporated into their wills, providing for the assets attributable to the vulnerable child to be held on discretionary trust with another sibling appointed as trustee, with clear guidance on distributions for care and living expenses.
The couple expressed that the arrangement gave them considerable peace of mind. They returned six months later for LPAs, understanding from their experience the importance of forward planning. All three documents are now in place.
